A.              8451 MELROSE AVENUE:

The applicant requests to amend an existing Minor Conditional Use Permit (MCUP 21-0004) and Administrative Permit (AP 21-0011) to expand a previously approved 600-square-foot rooftop dining area for a restaurant tenant space by an additional 1,833 square feet for a total rooftop area of 2,433 square feet. The request also includes incidental sales, service, and consumption of full alcohol within the expanded outdoor dining area. The use of outdoor dining is in conjunction with a previously approved separate buildout of the new 3,302-square-foot restaurant space in the existing multi-tenant commercial building. No additional parking is required for the expanded outdoor dining area. The project site is located at 8451 Melrose Avenue within the CN1 (Commercial, Neighborhood 1) zoning district.

RECOMMENDATION: Staff recommends that the Director of the Community Development Department hold the public hearing, consider all pertinent testimony, and take the following action:

 

1)    Draft Resolution No. CD 25-281: “A RESOLUTION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF THE CITY OF WEST HOLLYWOOD CONDITIONALLY APPROVING AN AMENDMENT TO A MINOR CONDITIONAL USE PERMIT AND AN AMENDMENT TO AN ADMINISTRATIVE PERMIT TO ALLOW THE SALES, SERVICE, AND CONSUMPTION OF FULL ALCOHOL INCIDENTAL TO FOOD SERVICE FOR THE EXPANSION OF AN EXISTING ROOFTOP DINING AREA FROM 600 SQUARE FEET TO 2,433 SQUARE FEET FOR A RESTAURANT LOCATED AT 8451 MELROSE AVENUE  (“CUCINA ALBA”), INCLUDING A FINDING THAT THE PROJECT IS EXEMPT FROM CEQA UNDER CLASS 3 CATEGORICAL EXEMPTION FOR NEW CONSTRUCTION TO A RESTAURANT (14 CCR §15303).” (EXHIBIT A).

APPEAL PROCEDURES


Any final determination by the Community Development Director may be appealed with just cause and such appeal must be filed within ten (10) calendar days after the Community Development Director’s Hearing action. This appeal shall be made in written form to the City Clerk’s Office stating the reason for the appeal and accompanied by an appeal fee or required number of signatures.

The City Clerk, upon filing of said appeal, will set petition for public hearing before the Planning Commission at the earliest date.
If you challenge any City of West Hollywood decision in court, you may be limited to raising only those issues you or someone else raised at the public hearing described on this agenda, or in a written correspondence delivered to the Community Development Director at, or prior to, the public hearing.
