All members of the public wishing to address the City Council, Redevelopment Agency and Novato Public Finance Authority are requested to submit a speaker card in advance to the City Clerk. The Mayor will call the names of speakers from the cards. Anyone wishing to speak on any item on the agenda other than those listed under Public Hearings (Section I) will be recognized at this time or at the time the item is heard. There is a three minute time limit. Items brought up during Public Comments that are not on the agenda can legally have no action. The City Council, Redevelopment Agency and Novato Public Finance Authority may direct that the item be referred to the City Manager for administrative action or may schedule the item on a subsequent agenda.

            2.         DESIGN REVIEW COMMITTEE NAME CHANGE

 

Consider second reading and adoption of an ordinance amending Section 2-11 to change the name of the Design Review Committee to “Design Review Commission.

 

Recommendation: Adopt ordinance.

 

            3.         AN ORDINANCE RESCINDING SECTION 2-14 PARKS AND RECREATION ADVISORY COMMISSION

 

Consider second reading and adoption of an ordinance rescinding Section 2-14, Parks & Recreation Advisory Commission, of the Novato Municipal Code.

 

Recommendation: Adopt ordinance.

 

            4.         HOUSING & BUILDING CODES APPEALS BOARD NAME CHANGE

 

Consider second reading and adoption of an ordinance amending Section 4-1.5 of the Novato Municipal Code, to change the name of the Housing & Building Codes Appeals Board to “Housing, Zoning and Building Codes Appeals Board.”

 

Recommendation: Adopt ordinance.

            5.         CALIFORNIA HEALTH AND SAFETY CODE SECTION 33342.7

 

Consider introducing an ordinance required by California Health and Safety Code Section 33342.7 stating that the Redevelopment Agency of the City of Novato does not possess the power of eminent domain.

 

Recommendation: Introduce ordinance.

 

            6.         MULTICULTURAL ADVISORY COMMISSION

 

Consider adopting a resolution rescinding and restating the Multicultural Commission to reduce the membership from seven to five and to rename the Commission “Multicultural Advisory Commission.”

 

Recommendation: Adopt resolution.

 

            7.         CONFIRMATION OF DECISIONS MADE AT THE WORKSHOP

ON MAY 14, 2007 REGARDING COUNCIL STANDING COMMITTEES

 

Consider rescinding the following City Council standing committees: College of Marin, Development Process Advisory, Hospital, Novato Unified School District, Safe Routes to Schools, and Solid Waste

 

Recommendation: Rescind the above standing committees.

 

            8.         GENERAL MUNICIPAL ELECTION ON NOVEMBER 6, 2007

 

Consider adopting a resolution calling for a General Municipal Election to be held on November 6, 2007 requesting the Marin County Board of Supervisors to consolidate the election with any other election and requesting election services by the County Clerk.

 

Recommendation: Adopt resolution.

 

            9.         NOVATO CHAMBER OF COMMERCE TOURISM COMMITTEE REPORT 2006

 

Consider accepting the 2006 Novato Chamber of Commercial Tourism Committee Report.

 

Recommendation: Accept the report.

 

            10.       GYMNASTICS PROGRAM INSURANCE

 

Consider approving the expenditure of $51,906 for general liability and excess insurance coverage for the Gymnastics program.

 

Recommendation: Approve request.

 

            11.       PIONEER PARK GAZEBO PROJECT

 

Receive status report and consider authorizing staff to purchase the gazebo and proceed with project.  

 

Recommendation: Authorize staff to proceed with project as outlined.

 

            12.       PURCHASE OF PARK MAINTENANCE EQUIPMENT

 

Consider approving the purchase of a Deep Tine Aerator and a Topdresser for the Maintenance Division

 

Recommendation: Approve purchase of equipment.

 

            13.       MULTI-YEAR USED OIL RECYCLING BLOCK AND HOUSEHOLD HAZARDOUS WASTE GRANTS

 

Consider adopting a resolution authorizing the City to submit grant applications for the Used Oil Recycling Block and Household Hazardous Waste Grant Programs and authorizing the City Manager or his/her designee to execute any and all documents associated with those programs.

 

Recommendation: Adopt resolution.

 

            14.       ALAMEDA DEL PRADO IMPROVEMENTS, MEASURE ‘B’ BOND GROUPS 5 & 6, MEASURE ‘A’ GROUP 1 PAVEMENT REHABILITATION PROJECT - PHASE 2

 

Consider awarding a construction contract to the lowest responsible bidder Graham Contractors, Inc., in the amount of $827,120, plus ten percent (10%) contingency of $82,712, totaling $909,832, to construct the Alameda Del Prado Improvements, Measure ‘B’ Bond Groups 5 & 6, Measure ‘A’ Group 1 Pavement Rehabilitation Project - Phase 2, CIP Project No. 03-003.

 

Recommendation: Award construction contract to Graham Contractors, Inc.

 

            15.       VARIOUS STREET IMPROVEMENTS

 

Consider approving plans and specifications and authorizing for bid advertisement for the Alameda Del Prado Improvements, Measure ‘B' Bond Groups 5 & 6, Measure ‘A' Group 1 Pavement Rehabilitation Project - Phase 3, CIP Project No. 03-003, Cypress Avenue Improvements Chapter 27 Assessment District, CIP Project No. 03-009 and Kendon Lane Assessment District and Street Improvements, CIP Project No. 04-001.

 

Recommendation: Approve project plans and specifications and authorize for bid advertisement.

 

            16.       IGNACIO BOULEVARD REHABILITATION BETWEEN LAURELWOOD DRIVE (EAST) AND SUNSET PARKWAY

 

Consider approving plans and specifications and authorizing bid advertisement for the Ignacio Boulevard Rehabilitation Between Laurelwood Drive (east end) and Sunset Parkway (CIP project No. 06-009).

 

Recommendation: Approve project plans and specifications and authorize bid advertisement.

 

            17.       CIP SURVEYING SERVICES AGREEMENT FOR FISCAL YEAR 2007/08

 

Consider authorizing the City Manager to execute a Consultant Services Agreement with North Bay Land Surveyors for surveying services associated with the CIP/Bond projects for fiscal year 2007/08, not to exceed $117,500.

 

Recommendation: Authorize the City Manager to execute a Consultant Services Agreement.

 

            18.       CANYON ROAD ROADSIDE DITCH REPLACEMENT

 

Consider approving plans and specifications and authorize bid advertisement for the Canyon Road Roadside Ditch Replacement, CIP # 07-007.

 

Recommendation: Approve the project plans and specifications and authorize for bid advertisement.

 

            19.       SAN MARIN DRIVE AND DAVIDSON STREET NEIGHBORHOOD SUBDRAIN AND PAVEMENT REPAIR PROJECT

 

Consider accepting the work, and authorizing the City Manager to sign the Notice of Completion for San Marin Drive and Davidson Street Neighborhood Subdrain and Pavement Repair Project, CIP Project No. 07-004 & 02-006.

 

Recommendation: Authorize the City Manager to sign the Notice of Completion.

 

            20.       ATHERTON RANCH SUBDIVISION

 

Consider adopting a resolution acknowledging completion of the improvements for the Atherton Ranch Subdivision and releasing a portion of the improvement securities in accordance with the Subdivision Improvement Agreement (SIA) for the project. Subdivider: Atherton Ranch, LLC.; Engineer: CSW/St2 Engineering Group, Inc.

 

Recommendation: Adopt resolution.

 

            21.       MEADOW PARK PHASE TWO SUBDIVISION

 

Consider adopting a resolution acknowledging completion of the improvements in Neighborhood 6 for the Meadow Park Phase Two Subdivision and releasing a portion of the improvement securities in accordance with the Subdivision Improvement Agreement (SIA) for the project. Subdivider: Novato Community Partners, L.L.C.; Engineer: CSW/St2 Engineering Group, Inc.
